Agreements effective 6 September 2026 · Payment Terms and Platform Agreements Version 1.1 effective 1 October 2026 · Governed by the laws of the State of Wyoming, USA
The General Terms of Service apply to everyone. If you list rooms, sell rooms, or collect payment yourself, one additional agreement also applies to you — find it in the table below. Two companies contract with you: Winkfluence Inc. is the platform, and TripPay Corporation collects and pays out money. Both are Wyoming corporations.
Which agreement applies to you
Section titled “Which agreement applies to you”| If you are | Your agreement |
|---|---|
| A traveller booking a stay | General Terms of Service |
| A hotel or other accommodation provider | Accommodation Provider Agreement and Accommodation Provider Payment Terms |
| A hotel activating the agent-collected channel | The above, plus the Agent-Collected Channel Addendum |
| An affiliate, creator, API partner or AI agent operator | Demand Partner Agreement and Demand Partner Payment Terms |
| A travel agent where TripPay collects payment | Demand Partner Agreement and Demand Partner Payment Terms |
| A travel agent collecting payment yourself, as merchant of record | Travel Agent Agreement |
The General Terms of Service apply to everyone. Where a role-specific agreement conflicts with them, that agreement takes precedence to the extent of the conflict.
Agreements
Section titled “Agreements”The umbrella document. Applies to every user of the platform and contains the booking terms for travellers, including how payment, cancellations and refunds work, and the arbitration agreement and class-action waiver in Section 17 with its 30-day opt-out.
Three separate agreements on one page, one per role. The Accommodation Provider Agreement covers supply, rate parity, add-ons, fees, chargebacks and relocation. The Demand Partner Agreement covers affiliates, creators, API partners and AI agent operators, with role-specific additions in Sections 8, 9 and 10. The Travel Agent Agreement is for agents approved to collect payment themselves as merchant of record. Each tab states who it is between.
Three separate agreements on one page, one per payment route — the Accommodation Provider Payment Terms (the appointment that makes TripPay the hotel’s limited payment collection agent), the Demand Partner Payment Terms (commission settlement; the partner never holds guest funds), and the Agent-Collected Channel Addendum (the travel agent collects and neither Wink nor TripPay is in the money flow).
