The Terms of Service apply to everyone. Where a role-specific agreement conflicts with them, that agreement takes precedence to the extent of the conflict.
Agreements
Section titled “Agreements”The umbrella document. Applies to every user of the platform and contains the booking terms for travellers, including how payment, cancellations and refunds work, and the arbitration agreement and class-action waiver in Section 17 with its 30-day opt-out.
For hotels and other accommodation providers listing supply. Covers supply and rate parity, add-ons, distribution channels, fees and commission, chargebacks with a fraud carve-out, operations, and overbooking and relocation obligations.
Between the hotel and TripPay Corporation. Section 1 is the appointment that makes TripPay the hotel’s limited payment collection agent — accepting these Payment Terms constitutes that appointment. Also covers collection, handling of funds, fees, payout, refunds, chargebacks and taxes.
Accepted by a hotel when it activates the agent-collected sales channel in the Extranet. On that channel the travel agent collects payment, neither Wink nor TripPay is in the money flow, and the hotel’s recourse for non-payment is against the agent.
For affiliates, creators, API partners, AI agent operators, and travel agents where TripPay collects. Common terms in Sections 1–7, with role-specific additions for API partners, creators and AI agent operators in Sections 8, 9 and 10.
How commission is calculated and paid. Section 1 is the mirror of the hotel appointment: the partner does not appoint TripPay and never holds guest funds.
For travel agents approved to collect payment themselves and act as merchant of record. Approval-gated, subject to a credit limit with automatic decline, with a 1.5% booking fee invoiced monthly. There is no payment collection fee, because TripPay is not collecting.
